New CGIA Limit Reminder

Every four years, the maximum liability limited by the CGIA is adjusted. For 2022, the Legislature increased the Colorado Governmental Immunity Act tort cap to the following:

  • $424,000 for any injury to one person in any single occurrence
  • $1,195,000 for any injury to two or more persons in any single occurrence; except that, in such instance, no person may recover in excess of $424,000

As a reminder, the CSD Pool provides its members with a $2,000,000 per occurrence limit under our Public Entity Liability coverage however this may not be enough to protect your district from discrimination claims.

These caps do not apply to allegations under federal law, such as allegations of employment, discrimination, or civil rights violations.

Due to the current and past awards in litigation against public entities, many districts have been steadily increasing their limits over time.
